Last month at the McDonald’s annual meeting there were thousands of protesters who gathered at the company’s headquarters to fight for higher wages. They were calling for minimum wage to be raised to $15 per hour. The protesters argued that at their current rate of pay (they receive on average $8 or $ 9 per hour), they cannot pay their bills.

Did you happen to hear the news story last week about the young man who was applying for a job with Staples via the web and was shocked to have received a questionnaire offering him the opportunity to disclose if he is an individual with a disability? As a Human Resource professional with a background in government contracting compliance I knew exactly why the opportunity to disclose was given to the applicant, and quite frankly I was not at all surprised the applicant was not aware of the new requirements in place for government contractors. The Family and Medical Leave Act (FMLA) turned 20 last year, celebrating two decades of providing employees with much needed job protection. For employers, the story is a little more complicated as many still struggle to understand the ever-evolving regulations and stay on top of court precedents. And even when the employer does everything right, sometimes the employee still fails to meet his or her responsibilities.

Just this past week the new rules by the Office of Federal Contracting Compliance Programs (OFCCP) went into effect in an effort to strengthen the recruitment efforts by government contractors to hire more veterans and persons with a disability. As a government contractor compliance SME, we hear a great deal about “good faith efforts” when it comes to recruiting but as a government contractor how do you exhibit the “good faith efforts” to the OFCCP if your company has been selected for an Affirmative Action Plan (AAP) audit?

When used properly, ICs (Independent Contractors) can be an excellent way to augment business services and operations. Classification continues to be hot button issue with the IRS. Misclassifying a position as an IC (also referred to as a 1099) when the position should be classified as an employee can create significant liability for a business, small or large. One of the more well known cases in recent memory involved a suit that Microsoft settled with a group of Independent Contractors for nearly $100M. At issue in the Microsoft suit was participation in various benefit programs, including employee stock options. But even small companies may find themselves targets of litigation. To help you understand exactly what is at stake, here are some areas of risk to keep in mind:
