There are thousands of government contractors who hold Service Contract Act contracts, yet so many of them are confused about the requirements. It’s understandable; the requirement guidelines are complicated and difficult to navigate. As an HR consultant with GovCon subject matter expertise, I often interpret the guidelines for many of our federal contracting clients to ensure they are in compliance. Here are a few tips to help clarify some of the most frequent misunderstandings I have discovered over the years consulting on the McNamara-O’Hara Service Contract Act of 1965, now known as the Service Contract Labor Standards.

Last month at the McDonald’s annual meeting there were thousands of protesters who gathered at the company’s headquarters to fight for higher wages. They were calling for minimum wage to be raised to $15 per hour. The protesters argued that at their current rate of pay (they receive on average $8 or $ 9 per hour), they cannot pay their bills.

Did you happen to hear the news story last week about the young man who was applying for a job with Staples via the web and was shocked to have received a questionnaire offering him the opportunity to disclose if he is an individual with a disability? As a Human Resource professional with a background in government contracting compliance I knew exactly why the opportunity to disclose was given to the applicant, and quite frankly I was not at all surprised the applicant was not aware of the new requirements in place for government contractors. But I began to wonder how many of the employees working for government contractors are unaware of these new regulations.

As a government contractor with 50 employees and $50,000 in government contracts, you are required to have an Affirmative Action Plan (AAP). Much of the information that goes into your AAP is collected from your applicants and employee population by providing them with an invitation to voluntarily self-identify.

The Family and Medical Leave Act (FMLA) turned 20 last year, celebrating two decades of providing employees with much needed job protection. For employers, the story is a little more complicated as many still struggle to understand the ever-evolving regulations and stay on top of court precedents. Compliance in small businesses can be particularly challenging as companies lack the internal expertise to interpret and comply with the law. And even when the employer does everything right, sometimes the employee still fails to meet his or her responsibilities.
